Domino’s, the pizza giant franchise, recently came under fire and will have to defend a lawsuit, for non-WCAG (Web Content Accessibility Guidelines) compliance on its websites. An appeal filed by the pizza franchise was rejected by the supreme court because “the federal court of appeals recognizes Domino's website as a place of public accommodation, requiring it to provide measures of accessibility for consumers”(ciodive.com).
While there are currently no laws in the U.S. requiring WCAG compliance, the Americans with Disability Act (ADA) is the most relevant standard for digital accessibility and is often the basis of the lawsuits that have been filed in the past. Because there is not any federal law requiring WCAG compliance, companies may not even understand the importance of websites that are accessible for all consumers, including those who are vision impaired, and take notice only when facing a potential lawsuit. Many may even rely on their web designer for ensuring compliance with certain guidelines, and falsely assume they have nothing to worry about.
Responsibility for compliance ultimately lies with the CIO, CTO, IT and the CAO of a company, and that person should work directly with whoever is coding the website to ensure the proper accessibility measures are being taken. Unfortunately, many small business owners don’t have a specific person in their organization dedicated to any of those positions, so the responsibility falls to them.
SeoSamba, a provider of comprehensive, high-performance digital marketing solutions for small businesses, franchise brands, and multi-location companies, is one of the few digital marketing providers who is taking a proactive approach to WCAG compliance for customers. SeoSamba has delivered high-quality W3C compliant websites for years, however, in an effort to protect their clients from potential lawsuits, they have decided to redouble their efforts and now offer WCAG AA compliance as a standard for any website built.
In addition, existing customers with websites under managed services are getting the most recent updates through their SeoToaster CMS and compliance remediation services applied at no-cost to them. Clients with websites not paired with a managed service can contact the company and ask for compliance updates for a nominal fee.
Compliance is an ongoing effort
SeoSamba has recently announced that they now integrates a stringent ADA scoring compliant checker system in their Marketing Operating System. Like any other automated tool, this is not intended to be a definitive answer as to whether you are likely to get sued. Instead, this is an excellent high-level indicator of your likely degree of compliance with the accessibility requirements mandated by the American Disability Act.
Customers with a premium Marketing Operating System license can now get their compliance status for all their websites, regardless of their platform, at their fingertips.
SeoSamba is also extending the WCAG compliance audit, consulting and expert resolution services to non-customers, as well. CEO Michel Leconte notes that “The fee we charge for this service is more than fair and certainly less expensive than a lawsuit.” If you are a small business owner and aren’t 100% sure your website meets the compliance guidelines, please contact SeoSamba right away. They will test your website for compliance at no charge, then provide you with an estimate for applying the updates to your website based on the results and discuss your options.
